FAQ About Dui Arrests in Canby, Oregon
When our clients hire us, one frequently asked question is “what if I refused to blow?” In Oregon, we have what is called the Implied Consent law, which says that Oregon drivers have already consented to a breath, blood, or urine test if asked by a police officer. Accordingly, refusing or failing one of those tests means that the DMV can move to suspend your license. The length of that suspension depends on a few factors, including what type of license you have and your history. Refusing a test will trigger a longer suspension than failing. However, there is a process to contest this DMV suspension – and Reynolds Defense Firm excels at the DMV hearing process. It is important to remember that whatever the DMV decides is separate from what the criminal court decides. Essentially, you have two separate entities that can affect your driving privileges after refusing to blow in when you are arrested for a DUI. To learn more about requesting a DMV hearing, go here.
